Terms of Service

These Terms of Service describe use of hartplumber.com and the referral and coordination services provided by Hart Commercial Services LLC, doing business as Hart Plumber ("Hart," "we," "us" or "our"). Hart Plumber - Sun City identifies the Sun City-facing brand on this website. They also explain the separate role of independent plumbing contractors. Contact us if you need clarification before submitting a request or authorizing work.

1. Hart’s role and independent contractors

Hart Commercial Services LLC is the marketing and referral business behind this website. It receives plumbing inquiries and shares each service request with one independent contractor. Hart receives a referral fee in connection with referred work. Hart does not itself perform plumbing repairs or installations. The independent contractor provides the assessment and quote, performs the work and handles any warranty it offers. References on this website to plumbing services describe the types of work for which a contractor connection may be requested.

A referral does not make the contractor a Hart employee. These website terms are not a plumbing work contract and do not replace the contractor’s written estimate, service agreement, required disclosures or obligations under applicable law. Payment collection through Hart’s payment processor does not, by itself, change who performs the work or provides the warranty.

2. Who may submit a request

Submit requests only if you are at least 18 and authorized to arrange service for the property, or are acting with the authorization of an owner or responsible person. Provide accurate contact information, the service location and a description of the issue. Tell the contractor about known hazards, access restrictions and property-management requirements before a visit. Do not submit another person’s information without authority.

3. Requests, coverage and availability

Submitting a form or calling Hart requests contact or service coordination; it does not confirm an appointment, price, arrival time or acceptance of a job. Arrangements must be confirmed with the contractor. Hart offers 24/7 inquiry handling and service coordination. Actual arrival and completion times depend on the location, problem, access, contractor availability, parts and conditions.

Listed communities and the coverage map illustrate the general service region rather than a guaranteed boundary. Service may extend beyond listed areas. Confirm availability for the actual job location. Website service hours do not represent public visiting hours at our address.

4. Emergencies and safety

This website is not an emergency response service. For immediate danger, a suspected gas leak, fire or electrical hazard, leave the unsafe area and contact the appropriate emergency service or utility from a safe location. Do not rely on a website request for an immediate response. General articles, photographs and FAQs do not diagnose your property’s condition or replace an on-site professional assessment. Do not attempt work beyond your knowledge or qualifications.

5. Contractor identity and qualifications

Before authorizing work, confirm the contractor’s identity, contact details, applicable license classification, insurance and the scope they are qualified to perform. No network-wide license, insurance or screening guarantee is created by these terms. Where licensing is required, verify the contractor through the Arizona Registrar of Contractors. These terms do not excuse a contractor or Hart from any duty imposed by law.

6. Estimates, fees and authorization

The independent contractor assesses the plumbing issue, proposes the work and provides the quote. Hart may set and collect a booking deposit and/or inspection fee. Any such amount, its purpose, when it is due, how it applies to the job balance and any applicable cancellation or refund conditions must be disclosed before you agree to pay. Submitting a website inquiry alone does not authorize a charge.

Before accepting a visit or authorizing work, confirm any diagnostic, service-call, after-hours, parts, labor, tax, permit or other charges in the applicable written agreement. Confirm the contractor’s identity and the scope, price and payment schedule. Additional work and price changes require appropriate authorization. These website terms do not replace required contractor agreements or statutory notices.

7. Square payments and collection on the contractor’s behalf

Under its arrangement with the independent contractor, Hart acts as a limited agent solely to invoice customers and collect customer payments on the contractor’s behalf. Hart uses Square to process payments. The business name shown on payment receipts and card statements is Hart Plumber; Square or your card issuer may add a processor prefix or otherwise format the description. A disclosed booking deposit or inspection fee may be collected at booking, with the remaining balance collected according to the customer’s agreement. Hart retains its agreed business fee and remits the contractor’s share under its separate contractor agreement.

Payment collection does not make Hart the provider of the plumbing work or workmanship warranty. Use the payment channel identified on the authorized invoice. Contractors are not authorized to accept direct cash, check, card or app payments from referred customers without Hart’s written consent; contact Hart to verify any different payment request.

Before paying, verify the amount, purpose, contractor, invoice and any deposit or payment schedule. Keep your receipt. Do not send card details through the quote form or ordinary email. These terms do not authorize recurring payments or unspecified future charges. Contact Hart about duplicate, incorrect or unauthorized transactions. Rights available through your card issuer, Square or applicable law remain intact.

8. Cancellations, rescheduling and refunds

Contact Hart promptly about cancellation, rescheduling or a refund, and notify the contractor when work has been scheduled. Any fee, deposit condition or refund restriction must be disclosed and agreed to for that transaction, subject to applicable law. This page does not impose an automatic cancellation charge or a blanket nonrefundable-deposit rule.

Hart coordinates payment and refund questions through its payment-processing arrangement; the contractor remains responsible for work and workmanship concerns. The separate agreement between Hart and the contractor allocates responsibility for refunds and chargebacks caused by the contractor’s work or conduct. That internal allocation does not reduce a customer’s rights or require the customer to resolve an internal fee dispute before raising a payment concern.

Refund eligibility and amounts depend on the authorized work, payments, agreed transaction terms and applicable law. Contact Hart with the invoice reference and reason for the request. Any applicable statutory cancellation or cooling-off rights remain in effect.

9. Workmanship, warranties and complaints

The contractor is responsible for the work it agrees to perform and any workmanship warranty it provides. Manufacturer warranties may apply separately. Obtain the applicable warranty terms, exclusions, duration and claim contact from the contractor before approving work. These website terms do not create an additional Hart workmanship warranty or remove any warranty or obligation imposed by law.

Raise workmanship and warranty issues with the contractor first. Hart can help coordinate contact. Send Hart the job date, contractor name, invoice reference and a concise explanation when requesting help; do not email full payment-card numbers or sensitive identity documents. You may also contact appropriate regulators, your payment provider or other available complaint channels.

10. Customer information and communications

When you submit a service request, you ask Hart to use your provided contact, location and service details to coordinate the request and share relevant information with one independent contractor who may contact you about it. The Privacy Policy explains the information involved, contractor sharing, current website tools and your choices. These terms do not substitute for that policy.

A service request is not blanket permission for unrelated marketing, automated advertising calls or texts. Any separate consent required for a communication method must be obtained separately. Agreement to these terms is not consent to call recording, a promotional subscription or automated marketing texts. A proposed owner-only SMS alert system is paused and is not an active customer texting program. Website submission is not consent to enroll customers in that internal alert system.

11. Website content, photos and reviews

Website materials provide general information. Photos illustrate plumbing work and are not a promise that the same methods, equipment, personnel or results will apply to your job. Pricing and diagnostic recommendations must be based on the actual assessment. A review or project example does not guarantee your experience.

Do not present another person’s reviews or images as your own. These terms do not restrict honest consumer reviews, lawful complaints or disclosures protected by law. Sending a private service photo does not, by itself, give Hart permission to publish it as advertising; publication permission should be obtained separately.

12. Permitted use and intellectual property

You may view and use this website to learn about services and make legitimate inquiries. Do not send fraudulent requests, impersonate others, upload malicious material, attempt unauthorized access, disrupt the website or submit unlawful or infringing content. Website branding, original text and other materials belong to their respective owners. No trademark rights or permission to commercially republish protected content are granted by using the site.

13. Third-party websites and website availability

Maps, external resources and payment services may be operated by third parties under their own terms and privacy practices. Links do not create a guarantee of third-party content. Hart aims to keep the website accurate and available but does not promise uninterrupted or error-free operation. If a request fails or you do not receive confirmation, call to follow up; do not assume the request has been received.

14. Responsibility and rights preserved

Each party remains responsible for its own acts and obligations under applicable law. These terms do not make Hart the plumbing contractor or guarantee a third party’s performance. They also do not exclude responsibility for Hart’s own conduct, fraud or other liability that cannot lawfully be excluded. No blanket liability waiver, fixed damages cap, mandatory arbitration agreement or class-action waiver is created by this page.

15. Governing law, concerns and changes

Arizona law governs these website terms to the extent permitted by applicable law, without taking away mandatory consumer protections that otherwise apply. Contact Hart to try to resolve a concern, but doing so is not a condition of exercising statutory rights or filing a lawful complaint or claim.

These terms take effect when this version is published on the website. Later changes apply prospectively and will not retroactively alter an already agreed service contract or payment authorization. Material changes requiring renewed agreement will be presented for acceptance where appropriate. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
